This Privacy Policy describes how Fortified Brands LLC ("Fortified," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit our Site, purchase our products, enroll in our subscription program, or interact with our marketing.

2. Information Collection & Use
2.1 Categories of Information Collected

Information you provide: name, shipping and billing address, email, phone, account credentials, order and subscription history, customer-service communications, product reviews and other User Content, survey responses, and any wellness or goal information you voluntarily submit.

Payment information: processed by our payment processors; we receive a tokenized reference and last-four digits. We do not retain full card numbers on our servers.

Automatically collected information: device identifiers, IP address, browser type, operating system, referring URL, pages viewed, links clicked, session duration, approximate location, and cookie/tracking identifiers.

From third parties: advertising and analytics partners, social platforms, affiliates, fraud-prevention vendors, and shipping/return-fulfillment vendors.
We do not intentionally collect biometric identifiers, government IDs, precise geolocation, or information about children under 13.
2.2 How We Use Information

2.3 Health-Related Information (CPRA / Washington My Health My Data Act)
To the extent we collect information that may be considered "sensitive personal information" or "consumer health data" under applicable law (for example, information you voluntarily provide about your supplementation habits, hydration goals, or wellness preferences), we use such information only for purposes permitted by law, such as processing your orders, providing customer support, operating and improving the Website, and sending you communications consistent with your choices. We do not use such information to make medical diagnoses or clinical decisions, and you should not rely on our processing of such information as medical advice or treatment.
Washington Residents — My Health My Data Act: If you are a Washington State resident, your consumer health data is protected under the Washington My Health My Data Act (WMHMD, RCW 19.373). Consumer health data we may collect includes information you voluntarily provide about wellness goals, hydration habits, or supplementation. We use this data solely for order fulfillment and customer support. We do not sell consumer health data. We do not use geofences around health-care facilities. We do not share consumer health data for cross-context behavioral advertising without separate, opt-in consent. Washington residents have the right to: (1) confirm whether we hold your consumer health data and access it, including categories of sources and third parties with which it has been shared; (2) withdraw consent for collection or sharing; (3) request deletion (we will delete without undue delay and within 30 calendar days, including from archived and backup systems, and will notify our processors and third parties); (4) appeal a denial. To exercise these rights, contact us at hello@livefortified.com. We do not require creation of a new account to exercise these rights.
Nevada Residents: Nevada's consumer health data law affords similar rights; to exercise, contact us at hello@livefortified.com.
2.4 Selling vs. Sharing (CPRA Disclosures)
SELLING: We do not sell your personal information for monetary consideration.
SHARING FOR CROSS-CONTEXT BEHAVIORAL ADVERTISING: We share certain personal information with third parties for cross-context behavioral advertising purposes, including advertising platforms (e.g., Meta Pixel, Google Ads, TikTok Pixel), email marketing platforms (e.g., Klaviyo), and analytics providers (e.g., Google Analytics 4). The specific tools currently in use are subject to change; for an up-to-date list, contact us using the information in Section 1.
Your Right to Opt-Out: California (and other-state) residents may opt out of sharing for cross-context behavioral advertising by: (1) clicking the "Do Not Sell or Share My Personal Information" link in the footer of www.livefortified.com; (2) transmitting the Global Privacy Control (GPC) browser signal, which we honor across all visitors as a matter of policy; or (3) submitting a CCPA/CPRA rights request using the contact information in Section 1.
SERVICE PROVIDERS: We disclose personal information to service providers who process data on our behalf under strict contract, including payment processors, shipping carriers, fulfillment and 3PL partners, customer-service platforms, fraud-prevention vendors, and our contract manufacturer Nutrabound for batch traceability. These disclosures are not "sales" or "sharing" under state law.
SMS Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. SMS originator opt-in data and consent are not shared with any third party.
2.5 Cookies and Tracking Technologies
We use the following categories of cookies and tracking technologies on our website:

Do Not Track: Browser DNT signals lack a uniform definition. We rely on the Global Privacy Control (GPC) for opt-out signaling.
2.6 SMS / Text Message Marketing
By providing your mobile number and opting in, you consent to receive recurring promotional and transactional text messages from Fortified at the number provided. Consent is not a condition of purchase. Message frequency varies (approximately 4–8 messages per month promotional; transactional messages sent as needed). Message and data rates may apply.
Prior Express Written Consent. We obtain prior express written consent through a clear, conspicuous opt-in (web form, checkout checkbox, or text-to-join keyword), disclosing: (a) program description; (b) message frequency; (c) "msg & data rates may apply"; (d) HELP and STOP instructions; (e) links to these Terms and to this Privacy Policy.

Eligibility. You must be 18 or older and the subscriber or authorized user of the mobile number you provide. You will notify us if your mobile number changes.
Compliance. Our SMS program follows the Telephone Consumer Protection Act (47 U.S.C. § 227) and FCC rules, the CAN-SPAM Act (where applicable to electronic messages), the CTIA Short Code Monitoring Handbook, carrier guidelines, and applicable state law.
2.7 Email Marketing
Fortified sends email marketing in compliance with the CAN-SPAM Act (15 U.S.C. §§ 7701 et seq.) and applicable state law:

Every commercial email identifies Fortified as sender, with a non-misleading "from" line and subject.

3. How We Disclose Information

4. Security; Retention; International Transfers
4.1 Security
We use commercially reasonable administrative, technical, and physical safeguards consistent with the New York SHIELD Act and analogous state security laws. No method of internet transmission is perfectly secure.
4.2 Retention
We retain personal information as long as needed to provide products and services, comply with legal obligations, resolve disputes, and enforce agreements. Subscription consent records are retained at least three years or one year after cancellation, whichever is longer.
4.3 International Visitors
Fortified ships within the United States only. If you visit the Site from outside the United States, your information will be processed in the United States, which may have data-protection laws different from those of your country.
5. State-Specific Privacy Rights Addenda
The addenda below supplement this Privacy Policy. To the extent of any conflict, the addendum prevails for the relevant resident.
5.1 California (CCPA / CPRA, CalOPPA, Shine the Light, Eraser Law, Financial Incentives)
Categories collected in the last 12 months: identifiers; commercial information; internet/network activity; geolocation (approximate); audio/visual (when you submit reviews or contact us); inferences. Categories disclosed for a business purpose include identifiers, commercial information, and internet/network activity (to service providers). Categories shared/sold for cross-context behavioral advertising include identifiers and internet/network activity.
Your rights as a California resident: (1) right to know/access; (2) right to delete; (3) right to correct; (4) right to opt out of sale/sharing; (5) right to limit use of sensitive personal information (we do not use sensitive PI beyond permitted purposes); (6) right of non-discrimination/non-retaliation; (7) right to data portability. We will respond within 45 days (extendable by 45). For sensitive requests we may require additional identity verification.
Shine the Light (Cal. Civ. Code § 1798.83): California residents may request once per year a list of categories of personal information disclosed to third parties for their direct-marketing purposes during the prior year. Email hello@livefortified.com.
Eraser Law (Cal. Bus. & Prof. Code §§ 22580–22582): California users under 18 with a registered account may request removal of content they posted. Email hello@livefortified.com.
Financial Incentives: If you enroll in our Subscribe & Save program, you receive a discount in exchange for ongoing data processing necessary to operate the subscription. The estimated value of this incentive equals the price differential between the one-time and subscription prices. You may withdraw at any time by cancelling your subscription.
Authorized agents must provide signed permission and verification.
5.2 Texas (TDPSA — Tex. Bus. & Com. Code Ch. 541)
Texas residents have rights to: (1) confirm processing; (2) access personal data; (3) correct inaccuracies; (4) delete; (5) portability; (6) opt out of targeted advertising, sale of personal data, and profiling that produces legal or similarly significant effects. We honor universal opt-out signals, including GPC, effective January 1, 2025. We process sensitive data only with your affirmative consent. We do not sell sensitive personal data. We do not sell biometric data. Response window: 45 days, extendable by 45. Appeal: 60 days. If we deny your appeal, we will provide the online method to contact the Texas Attorney General. Enforcement is by the Texas Attorney General; there is no private right of action.
5.3 Other State Privacy Laws
Residents of the following states (each in effect as of May 11, 2026) have, at a minimum: (1) right to confirm/access; (2) right to correct (Utah and Iowa do not require correction); (3) right to delete; (4) right to portability; (5) right to opt out of targeted advertising and sale; and, in most states, opt out of profiling with legal/similar significant effect. Covered states: Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Oregon (OCPA), Montana (MTCDPA as amended by SB 297), Iowa (ICDPA), Indiana (ICDPA), Tennessee (TIPA), Delaware (DPDPA), New Hampshire (NHDPA), New Jersey (NJDPA), Nebraska (NDPA), Maryland (MODPA — enforcement begins April 1, 2026), Minnesota (MCDPA), Rhode Island (RIDTPPA), Kentucky (KCDPA).
Universal Opt-Out / GPC honored for: California, Colorado, Connecticut, Texas, Oregon, Montana, Delaware, New Hampshire, New Jersey, Minnesota, Maryland, and any other state where required as of the date a request is made.
Minnesota-specific: right to a list of specific third parties to which personal data has been disclosed; right to question profiling outcomes and require human review of profiling decisions producing legal/similar significant effects.
Oregon-specific: right to a list of specific third parties to which personal data has been disclosed; sale of precise geolocation prohibited; sale of personal data of consumers under 16 with actual knowledge or willful disregard is prohibited.
Maryland (MODPA) — stricter rules: Sale of sensitive data is prohibited regardless of consent. Collection of sensitive data must be "strictly necessary" to provide the requested product or service. We do not sell sensitive data and process sensitive data only as strictly necessary. Targeted advertising and data sales involving consumers we know or should know are under 18 are prohibited.
Rhode Island (RIDTPPA): notably low applicability thresholds (35,000 consumers, or 10,000 if >20% revenue from sales of personal data); AG sole enforcer; no private right of action.
Florida (FDBR): narrow scope. Fortified does not currently meet the FDBR's applicability thresholds. Florida residents nonetheless retain the rights described in this Policy as a matter of policy.
No-discrimination: Across all states, we do not deny goods or services, charge different prices, or provide different quality based on the exercise of privacy rights, except where permitted (e.g., a financial-incentive program operated with notice).
5.4 New York (SHIELD Act, GBL §§ 349–350)
We maintain reasonable administrative, technical, and physical safeguards under the SHIELD Act and disclose materially accurate information about products and prices, consistent with GBL §§ 349 and 350.
5.5 Illinois (BIPA) and Texas (CUBI — Tex. Bus. & Com. Code § 503.001)
Fortified does not collect, store, or use biometric identifiers or biometric information. These laws are referenced for completeness; they do not currently impose obligations on Fortified.
6. Children's Privacy (COPPA)
Fortified's Site and products are intended for adults. The Site is not directed to children under 13. Consistent with the Children's Online Privacy Protection Act (COPPA, 15 U.S.C. §§ 6501 et seq.) and applicable state minor-protection laws (Maryland MODPA's expanded protections for individuals under 18, Connecticut's age-appropriate-design code, Oregon HB 2008's prohibition on sale of personal data with knowledge of consumers under 16, and the Texas SCOPE Act to the extent applicable):
